Non-refundable Deposit
Client agrees to pay the full amount due under this contract, even if client actually uses the artist for less time than contracted for. There is a non-refundable $100 deposit. This deposit does go towards the total cost of the event. Deposit will need to be paid through PayPal. Checks will not be accepted.
Remainder of Booking Fee
In the event that Client cancels, the $100 deposit fee is non-refundable. The deposit can be applied to a future event within the next six months if cancellation is four days prior to the event (a postponed event). Any cancellation without postponement will only be refunded the remainder of the booking fee (total minus the deposit) if total booking fee was already paid. Cancellations within four days of the event will not be refunded and must be paid in full. In the event of a weather event postponing an event, Faber Art Ventures will agree to a rain date if discussed TWO days before the day of the event.
Cancellation/Postponement
The remainder of the payment (the total cost minus the deposit paid) can be paid through PayPal before the event or by cash at the event. Client agrees to pay full amount even if client actually uses the artist for less time than booked. At small private events it is wise to create a list of individuals that would like to be painted and let the artist use the list to ensure the appropriate guests have their faces painted in the allotted time. Additional guests would be accommodated after the guests list has been completed if still in the allotted time. Additional time fees will be billed to accommodate the uninvited guests (i.e. siblings of invited guests) should the client and artist agree to add additional time for face painting.
Booking Date
The time slot will not be reserved for the client until the deposit is paid and the agreement is signed. Digitally approved agreements will hold the booking date for seven (7) days to allow time for deposit. If the deposit is not received within seven (7) days of receipt of the digitally agreed contract, the contract agreement is null and void. Should the artist be unable to perform its contracted services for any reason whatsoever, the deposit and any amounts paid by the client under this contract agreement, will be refunded, with the exception of any specialty supplies purchased for the client, at the client’s request, in which case the cost of the special items purchased will be deducted from the amount refunded and the specialty items will be available for the client to pick up from the artist.
Additional Time
Any time beyond the time booked will cost $110 per hour, per Artist (for single rate events) or $75 per hour, per artist (for per face events), with a full hour charge being due for each 1-60 minutes of overtime. However, only booked times with deposits are guaranteed, additional time on the day of the event may not be available, although the artist will attempt to accommodate requests for additional paid time.
Breaks
The artist will be provided with paid 10 minute breaks for every two hours of contracted time.
Parking
The artist will be provided with parking in the driveway of the home where services will be provided. If the event is at a commercial facility, the artist will be provided a parking spot next to the commercial facility entrance door. Parking near the place services are provided is necessary to enable the artist to unload equipment. The client will reimburse the artist for any parking fees incurred while the artist is providing its contract agreement services to the client.
Working Area
The artist will need a 10’ x 10’ area and will need to be positioned at the furthest possible distance from any sound systems and/or physical activity (i.e. children running/playing, ball/yard games, bounce houses, etc.) where the artist’s supplies may be accidentally knocked over. The area will also need to have sufficient lighting. This is especially important for indoor or evening/night time events. Additional lighting can be provided by Faber Art Ventures for an additional $50 fee.
Weather Shelter
The artist will be able to face paint outdoors under proper weather conditions, but a suitable shelter is required in every circumstance. A secure covered area (patio, indoor) must be provided for rainy conditions, an indoor area must be provided for extremely windy conditions, and a covered area (i.e. patio cover) or pop up tent must be provided for a sunny day/extreme heat conditions. A pop up tent can be provided by Faber Art Ventures for an additional $75 fee, but will require assistance in setup and transport. A provided pop-up tent in rainy or strong wind conditions will not be set up, and will require an indoor location.
Limitations On Artwork
The artist will not paint on any part of the body that is not legal to expose, or any place the artist does not feel comfortable painting. The artist will not paint any design or wording that is obscene, offensive or defies good taste. The artist may refuse to paint any symbols or other illustrations that are commonly attributed to “gang” or other illegal group affiliations. The artist will not paint any designs that the artist is not comfortable painting.
Artist will not supervise children
The behavior and safety of all children and adults is the Parents’ responsibility, and not the artist’s. Artist cannot see other children and what they are doing while she is painting.
Adverse Working Conditions
The artist has the right to cease painting and leave without refunding any monies if there are extreme adverse working conditions and the client fails to remedy the situation after it has been brought to the client’s attention. Adverse conditions included but not limited to: destructive, violent, or extreme environments, inappropriate behavior of a child or adult, illegal activities, dangerous weather or work environment conditions, dangerous conditions in general.
Photo Consent
By having your Guests' face painted and photographed, permission is thereby granted to use images for Faber Art Ventures portfolio/marketing materials (such as print, website, social media or other publications). No names are ever revealed. If for any reason your guest, or you, does not agree, please email Faber Art Ventures at faberartventures@gmail.com prior to the event, and their privacy will be respected.
Liability Statement
The artist is not liable for any parties’ allergic reactions to paints. Paints and products that are used are all deemed safe for face painting. However, reactions can occur. It is the parent’s responsibility to notify the artist if their child has sensitive skin. Children with skin allergies or sensitive skin should either not participate, or have the artist perform a patch test at the beginning of the party. Children under 1 years old cannot have their face painted to stay in line with safety standards. For sanitary reasons, the artist will not paint anyone who is or appears to be sick or be suffering from: cold sores, conjunctivitis, any infectious skin condition, eczema, or open wounds. The artist reserves the right to deny face painting due to illness. The artist will use reasonable care, but is not responsible for damage to clothing or property.
Faber Art Ventures agrees
to provide services of general face painting using compliant products on said contract agreement dates, with acceptance and timely payment of the $100 deposit. Faber Art Ventures also agrees that a liability insurance policy is in full force and effect and will provide a current insurance certificate upon request. For any reason, should Faber Art Ventures be unable to accommodate the client’s booking, a full refund of the paid fees will be returned to the client or the client may receive another event for the equal amount of time, provided the client and Faber Art Ventures can agree on an available day and time period for the next event and the next event is to occur within a reasonable period of time. In the event that the artist is unable to perform, the client agrees that a full refund of any amounts paid will represent a full satisfaction of any and all amounts due from Faber Art Ventures and a demand for the full amount paid to Faber Art Ventures the client’s full recourse for any and all claims by client. This means that Faber Art Ventures is liable to the client for no further claim of damages or other claims of any kind whatsoever, beyond a full refund of any amounts paid by the client to Faber Art Ventures.
Client agrees
to pay the full amount of booked time of face painting services. The client will be responsible for any fees or expenses, including attorney’s fees, incurred in connection with collecting delinquent amounts owed to Faber Art Ventures under this Agreement.
It is the responsibility of the client to obtain permission from parents/caregivers for all children expected to take part in face painting.
The client acknowledges that there are risks inherent with live entertainment. These include, but are not limited to, dangers from tripping over equipment, dangers from paint and paint brushes. The client assumes the liability for all such risks and agrees to indemnify, defend, and hold harmless Faber Art Ventures and against any and all accidents, claims, judgments, costs or liability for damage, and/or injury to any person or property during the event, including time of set up and takedown, by guests and staff. Liability shall not exceed the total value of this agreement.
